BARNSTABLE, Mass.—A charge against a Massachusetts state trooper accused of illegally storing a gun taken by his young son has been dismissed.
Barnstable District Court Judge W. James O'Neill ended the case against Lt. Richard Bolduc of Sandwich, who declined comment after the brief hearing Friday.
Bolduc was accused of leaving his service weapon in an unlocked bureau. Police said that on June 25 last year, Bolduc's 12-year-old son took the gun, pointed it at a 5-year-old neighbor and pulled the trigger. The gun was not loaded and no one was hurt, but police they found a loaded clip where the gun was stored.
Bolduc's lawyer said the charge should be dismissed after a Supreme Court ruling that requiring trigger locks hinders a person's right to self defense.
We'll see whether this is a case of the Courts acting in agreement with the Supreme Court of the United States in Heller Vs. D.C. or a case of a State Police Officer getting a pass. Unfortunately we won't know until a this happens to an average joe.
